Governing Law
Please Read
Please read these Terms and Conditions carefully before engaging our plumbing services.
By scheduling a service call, accepting a written quote, or permitting us to perform work at your property, you agree to be bound by these terms.
Section 1
1. Services and Service Agreement
1.1 Truckee Plumber (“Company,” “we,” “us”) provides licensed plumbing services to residential and commercial customers in Truckee, CA and the Greater North Lake Tahoe area, including Nevada County and Placer County jurisdictions.
1.2 All services are provided pursuant to a written Service Agreement or approved written quote. No work will begin without a written quote that the customer has accepted, whether in person, by phone, by text message, or by email. Verbal acceptance of a written quote constitutes agreement to these Terms and Conditions.
1.3 The scope of work is defined by the written quote. Any additional work identified during the course of a job will be communicated to the customer before proceeding. No additional charges will be applied for work not approved by the customer.
1.4 Truckee Plumber operates under California Contractor CA C-36 Plumbing License — verify at CSLB, issued by the California Contractors State License Board (CSLB). Customers may verify license status at cslb.ca.gov.
Section 2
2. Pricing and Payment
2.1 All pricing is provided in a written quote prior to commencement of work. The final invoice will not exceed the approved quote amount, except for additional work explicitly approved by the customer during the job.
2.2 Payment is due upon completion of the work for standard service calls. For larger projects, payment schedule terms will be specified in the written quote and may include a deposit of no more than 10% of the total contract value, as permitted under California Business and Professions Code Section 7159.
2.3 We accept credit card and bank transfer. For vacation property owners managing accounts remotely, digital invoice payment by credit card or bank transfer is available.
2.4 Invoices not paid by the due date stated on the invoice may be subject to a finance charge not to exceed the maximum permitted under California law.
2.5 In the event that collection action is required, the prevailing party in any dispute shall be entitled to recover reasonable attorney’s fees and costs, as permitted by California law.
Section 3
3. Scheduling, Access, and Cancellation
3.1 We make reasonable efforts to arrive within the agreed service window. For emergency calls, we provide an estimated time of arrival and communicate proactively if conditions (chain control, road closures, weather) affect that estimate.
3.2 The customer or an authorised representative is responsible for ensuring we have safe access to the property and the specific areas requiring service. For vacation properties, this includes providing property manager contact information, access codes, or key holder information in advance.
3.3 Scheduled (non-emergency) appointments may be cancelled or rescheduled without charge with at least 24 hours’ advance notice. Cancellations within 24 hours of a scheduled appointment may be subject to a cancellation fee to cover dispatched technician time, as stated on your quote or confirmation.
3.4 We reserve the right to decline or discontinue service at any property where conditions create a safety risk to our technicians, or where access is not available as agreed.
Section 4
4. Warranties and Workmanship Guarantee
4.1 We warrant all labour performed by Truckee Plumber to be free from defects in workmanship for a period of 90 days from the date of service completion (“Workmanship Warranty Period”). If a repair fails within the Workmanship Warranty Period due to defective workmanship, we will return and correct the issue at no additional charge.
4.2 Parts and materials are warranted pursuant to the manufacturer’s warranty for the specific part or material installed. We will facilitate warranty claims on manufacturer-defective parts installed by us during the Workmanship Warranty Period.
4.3 The workmanship warranty does not cover: (a) damage caused by the customer or third parties after service completion; (b) pre-existing conditions in the plumbing system not addressed in the scope of work; (c) damage caused by events outside our control, including but not limited to freeze events, floods, earthquakes, or acts of nature; (d) work performed by others on the same system after our service visit.
4.4 The warranty described in Section 4.1 is the exclusive warranty provided by Truckee Plumber and is given in lieu of any other warranty, express or implied, including any implied warranty of merchantability or fitness for a particular purpose.
Section 5
5. Limitation of Liability
5.1 Truckee Plumber’s liability for any claim arising out of services provided under these Terms and Conditions is limited to the amount paid by the customer for the specific service giving rise to the claim.
5.2 Truckee Plumber shall not be liable for indirect, incidental, consequential, or punitive damages, including but not limited to loss of use, lost rental income, lost business, or property damage not directly caused by our negligent workmanship, regardless of whether we have been advised of the possibility of such damages.
5.3 Truckee Plumber carries general liability insurance. A certificate of insurance is available upon request.
5.4 We are not responsible for pre-existing conditions in the plumbing system, including aging pipes, original factory defects, or conditions that were not within the scope of the work we were engaged to perform.
Section 6
6. Property Access and Customer Responsibilities
6.1 The customer represents that they have the authority to authorise plumbing work at the property and grant access to Truckee Plumber personnel.
6.2 The customer is responsible for informing us of any known hazards at the property, including but not limited to asbestos, lead paint, mold, structural instability, or known utility conflicts.
6.3 For vacation properties: when access is provided through a property manager, key holder, or access code, the customer authorises us to perform the approved scope of work in reliance on that access authorisation. We will communicate with the property manager and the remote owner as agreed in advance.
6.4 We will restore the property as closely as reasonably possible to its pre-service condition. Drywall or flooring access cuts required for leak detection or pipe repair will be left clean and clearly defined. Finish work beyond the plumbing repair itself (painting, tile replacement, flooring restoration) is outside our scope unless specifically included in the written quote.
Section 7
7. Permits and Code Compliance
7.1 Where building permits are required by Nevada County, Placer County, or the Town of Truckee for the work to be performed, Truckee Plumber will obtain the required permits as part of the project scope. Permit costs are included in the written quote unless otherwise specified.
7.2 All work performed by Truckee Plumber will comply with applicable California Plumbing Code, local amendments, and the requirements of the applicable permitting jurisdiction.
7.3 For work in HOA-governed communities (Tahoe Donner, Northstar, Lahontan, Martis Camp, and others), we will comply with HOA notification and approval requirements as applicable. The customer is responsible for informing us of any specific HOA requirements they are aware of beyond standard contractor notification procedures.
Section 8
8. Dispute Resolution
8.1 In the event of any dispute arising from services provided under these Terms and Conditions, the parties agree to first attempt resolution through good-faith direct communication.
8.2 If direct resolution is unsuccessful, the parties agree to submit the dispute to binding arbitration in Nevada County, California, administered by a mutually agreed-upon arbitrator, before pursuing litigation. The arbitrator’s decision shall be final and binding.
8.3 These Terms and Conditions shall be governed by the laws of the State of California. Any litigation not resolved by arbitration shall be brought in the courts of Nevada County, California.
Section 9
9. Privacy
9.1 We collect customer name, address, contact information, and service history for the purpose of providing plumbing services and maintaining service records. We do not sell customer information to third parties.
9.2 Job photographs taken as part of our documentation process are kept in our internal records and provided to the customer upon completion. We may use anonymised before-and-after photographs for marketing purposes; if you prefer your property photographs not be used in this way, please inform us at the time of service.
Section 10
